1. Authorisation
The client authorises DRC Australia or its partners to conduct an evaluation of the media sent to determine the nature of the damage and provide an estimate of the data recovery cost and turnaround. The client hereby represents, warrants, and affirms that he, she, or it is the owner or the authorised representative of the owner of the property and all of the information and data stored on said property. By asking DRC Australia to provide data recovery or forensic services, you declare that the forgoing representations are true and correct.
The evaluation for logical and firmware issue is free and no work beyond this evaluation will be charged
without explicit client approval.
Non refund for inspection fee or spare parts, or donor drive fee, will apply to attempt recovery data for losses caused by mechanical or electrical failure, accidental damaged, water, fire, or smoke damage, or extended inspection engineer time is required or any severe damaged on the media or equipment.For data recovery services on mobile phones, a non refundable inspection fee will apply due to the extensive time require to retrieve lost data, from different level of encryption and data protection from mobile phone manufacturers.
2. Failure to claim property
Any property left with DRC Australia unclaimed for 30 days, and due to storage and security reason will be disposed or recycled. At which time, DRC Australia shall have no liability to the client or any third party. Storage fee of $10 per day will apply if the customer failed to collect the property within 30 days.
3. Limited Liability
DRC Australia shall not be liable as a result of this agreement or the performance of any data recovery services or evaluation of the possibility of providing data recovery or forensic services, for any claims regarding the physical functioning of equipment OR media or the condition or existence of data on storage media supplied before, during or after service.
The client understands that a hard drive, flash drive, memory card or mobile phone, or media device may fail at any time even while in the possession of DRC Australia Pty Ltd and shall not hold DRC Australia Pty Ltd for any such failure.
The Customer acknowledges that the equipment/data/media may be damaged prior to DRC's receipt, and the Customer further acknowledges that the efforts of DRC to complete the data recovery may result in the destruction of or further damage to the equipment/data/media.
DRC for itself does not assume responsibility for additional damage that may occur to the Customer's Equipment/Date/Media during or as a result of DRC's efforts to complete the data recovery or forensic services.
THE CLIENT UNDERSTANDS THAT DATA RECOVERY CANNOT BE GUARANTEED, if the hard drive/media has been severely damaged, or in case of physical failure of storage media.
All data recovered will be kept for a period of 10 days after successful delivery to customer. Data will be destroyed and thereafter no further records will be kept.
In no event will DRC be liable for any damages whatsoever, including, without limitation, damages for loss of data, loss of business profits, business interruption, or other pecuniary loss, or incidental, consequential, or indirect damages arising from the data recovery services if DRC or any authorized representative has been advised of the possibility of such damages. The total liability of DRC or its suppliers to the Customer under this agreement shall in no event exceed the total sums paid by the customer to DRC.
4. Free Pickup
Free of charge pickup applies to Eastern Suburb and Sydney CBD customers only and must booked before 11:00 AM Monday to Friday.
Other areas, unless otherwise agreed, charges apply for a pickup.
5. Confidentiality
DRC Australia agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client equipment except to employees or agents of DRC Australia subject to confidentiality agreements or as required by law.
6. Payment
Payment is due in full upon completion of Data recovery or Forensic services, prior to release of data (whether shipped, picked up or downloaded), unless by special previous arrangement.
Successful data recovery is defined as recovery of data that was not accessible or visible under the client's computer operating system.
The client agrees to pay for data recovery even if DRC Australia has partially recovered the data.
No data, no fee applies only when no data recovery is possible to recover, after our best effort.
The client is financially responsible for all shipping costs, custom duties and taxes to and from DRC Australia. We ONLY accept VISA, MasterCard, cheque, bank deposit or cash.
7. Warranty
DRC Australia makes no warranty, express or implied, and DRC Australia disclaims any warranty of any kind, for the services being provided or discussed hereunder.
